It shall be unlawful for an owner or tenant of real property to permit or allow any animal (excluding a dog or a cat, including but not limited to any pet, farm animal, or bird) owned by , or under the control of , the owner or tenant or real property to enter upon the real property of another without the permission of the owner or tenant of such real property.

The absence of secure fencing or other secure structure to serve as a containment mechanism shall result in the presumption that the owner or tenant of real property permitted or allowed the trespass of the animal upon the real property of another.

Comment from me: THIS DOES NOT SAY SECURE FENCING GETS YOU OFF THE HOOK. In fact Ross says on chicken law dvd #1 that any escape proves that the fence was not secure. What it seems to do is let the town prove the tresspass without seeing it.

Alleged violations of the local law shall be filed by the Town's zoning enforcement officer in the town of stuyvesant justice court and adjudicated in accordance with the rules of criminal procedure.
